Federal Judge Orders Release of Abrego Garcia from Immigration Detention

A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to face human smuggling allegations, he was held in immigration custody.

In her order, the judge pointed out that the government lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal challenge center on disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.

Terms of Release

The court, who was hearing his challenge to removal in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
